  1. Introduction

Welcome to FIFO Collective (“FIFO Collective”, “we”, “our”, “us”).

FIFO Collective is a membership-based platform that provides members with access to curated offers, discounts, promotions, experiences and benefits from third-party partner businesses (“Partners”).

By accessing, browsing, registering for, or using FIFO Collective, you agree to these Terms & Conditions (“Terms”).

If you do not agree to these Terms, you must not use the platform.

  1. Eligibility

To use FIFO Collective, you must:

  • be at least 18 years old; 
  • reside in Australia or otherwise lawfully access the platform; 
  • provide accurate and current account information; and 
  • use the platform for personal, non-commercial purposes only. 

We reserve the right to suspend or terminate accounts that breach these Terms.

  1. Memberships

FIFO Collective memberships may be offered on:

  • monthly subscription plans; 
  • yearly subscription plans; and/or 
  • promotional or founding member offers. 

Membership pricing, inclusions and availability may change from time to time.

Your membership grants you access to:

  • gated member-only offers; 
  • partner promotions; 
  • platform features; and 
  • other benefits determined by FIFO Collective. 

Memberships are personal to the account holder and must not be shared, transferred or resold.

  1. Subscription Billing & Auto-Renewal

By purchasing a membership, you authorise FIFO Collective to charge the applicable subscription fees using your selected payment method.

Unless cancelled before renewal:

  • monthly memberships automatically renew monthly; and 
  • yearly memberships automatically renew annually. 

You may cancel your membership at any time through your account settings or by contacting us.

Cancellation prevents future renewals only and does not automatically entitle you to a refund for the current billing period.

  1. Refunds

Unless otherwise required under Australian Consumer Law:

  • membership fees are generally non-refundable; 
  • change-of-mind refunds are not provided; 
  • partial refunds are not issued for unused time or benefits. 

Where required by law, nothing in these Terms excludes your rights under the Australian Consumer Law.

  1. Partner Offers & Promotions

FIFO Collective provides access to offers made available by independent third-party Partners.

Offers may:

  • vary by location; 
  • be time-limited; 
  • be changed or withdrawn; 
  • have redemption limits; 
  • require bookings; 
  • require active membership verification; or 
  • be subject to additional Partner terms. 

FIFO Collective does not guarantee:

  • offer availability; 
  • stock availability; 
  • booking availability; 
  • pricing accuracy; 
  • continued participation by Partners; or 
  • specific savings outcomes. 

Partners may modify or discontinue offers at any time.

  1. Third-Party Businesses

FIFO Collective does not own, operate or control Partner businesses.

Any products, services, bookings, experiences or transactions you enter into with a Partner are solely between you and the Partner.

FIFO Collective is not responsible for:

  • Partner conduct; 
  • quality of goods or services; 
  • booking disputes; 
  • cancellations; 
  • injuries; 
  • losses; 
  • property damage; 
  • customer service issues; or 
  • any acts or omissions of Partners. 

You engage with Partners at your own risk.

  1. Member Verification & Redemption

Some offers may require:

  • active login; 
  • digital membership verification; 
  • rotating codes; 
  • QR verification; 
  • in-store confirmation; or 
  • other authentication methods. 

FIFO Collective and Partners reserve the right to refuse redemption where:

  • membership cannot be verified; 
  • misuse is suspected; or 
  • Terms have been breached. 
  1. Prohibited Conduct

You must not:

  • share member-only offers publicly; 
  • distribute or resell codes; 
  • screenshot or reproduce protected offers for non-members; 
  • use the platform fraudulently; 
  • impersonate another person; 
  • scrape, copy or harvest platform data; 
  • interfere with platform functionality; 
  • use the platform for commercial resale purposes; or 
  • attempt to bypass gated access systems. 
  1. Account Suspension & Termination

FIFO Collective may suspend, restrict or terminate accounts where we reasonably believe:

  • these Terms have been breached; 
  • fraudulent activity has occurred; 
  • membership sharing is occurring; 
  • redemption abuse exists; or 
  • platform misuse has taken place. 

We may also remove access to specific offers or features at our discretion.

  1. Intellectual Property

All platform content including:

  • branding; 
  • logos; 
  • text; 
  • graphics; 
  • offer layouts; 
  • platform structure; 
  • software; 
  • imagery; and 
  • marketing material 

is owned by or licensed to FIFO Collective and protected by Australian intellectual property laws.

You may not:

  • reproduce; 
  • distribute; 
  • copy; 
  • commercially exploit; or 
  • modify platform content without written permission. 
  1. Privacy & Communications

By creating an account, you acknowledge that FIFO Collective may collect and use personal information in accordance with our Privacy Policy.

This may include:

  • account information; 
  • usage data; 
  • redemption activity; 
  • email addresses; 
  • marketing preferences; and 
  • communications history. 

You consent to receiving:

  • service communications; 
  • account notices; 
  • offer updates; and 
  • marketing emails, 

unless you opt out where permitted.

  1. Platform Availability

FIFO Collective aims to maintain platform availability but does not guarantee uninterrupted access.

We may:

  • modify features; 
  • update content; 
  • perform maintenance; 
  • remove functionality; or 
  • suspend access temporarily. 

We are not liable for outages, downtime or technical interruptions.

  1. Limitation of Liability

To the maximum extent permitted by law:

FIFO Collective excludes liability for:

  • indirect loss; 
  • consequential loss; 
  • loss of profits; 
  • loss of opportunity; 
  • business interruption; 
  • reputational damage; and 
  • data loss. 

Our total liability in connection with your use of the platform will not exceed the amount paid by you to FIFO Collective in the previous 12 months.

Nothing in these Terms excludes rights that cannot legally be excluded under Australian Consumer Law.

  1. Indemnity

You agree to indemnify FIFO Collective against claims, losses, liabilities, damages or expenses arising from:

  • your misuse of the platform; 
  • breach of these Terms; 
  • unlawful conduct; or 
  • misuse of Partner offers. 
  1. Governing Law

These Terms are governed by the laws of Western Australia.

Any disputes arising from these Terms or platform use are subject to the exclusive jurisdiction of the courts of Western Australia.

  1. Changes to Terms

FIFO Collective may update these Terms from time to time.

Updated Terms take effect once published on the platform.

Continued use of the platform after changes are published constitutes acceptance of the updated Terms.
